ELIGIBILITY:

The 3 Amigos Restaurants 2025 contest (the “Giveaway”) is open only to legal residents of Quebec who are at least eighteen (18) years old at the time of entry (the “Participants”). Employees, officers, and representatives of 3 Amigos Restaurants, the administrator, and their respective affiliates, as well as immediate family members (spouse, parents, siblings, and children) and those living in the same household of each such employee (collectively, the “Giveaway Entities”), are not eligible to participate. Subject to all applicable provincial, territorial, and local laws and regulations. Void where prohibited or restricted.

ACCEPTANCE OF OFFICIAL RULES:

By participating in the Giveaway, participants agree to abide by and be bound by these Official Rules, which are final and binding in all matters relating to the 3 Amigos Restaurants contest. Winning the Grand Prize (as defined below) is contingent upon fulfilling all requirements set forth herein.

HOW TO ENTER:

Participants may enter for a chance to win the Grand Prize from May 1, 2025, until the official end date of 5:00 PM on June 4, 2025 (the “Giveaway Period”) and must be residents of Quebec. The 3 Amigos Restaurants database is the official timekeeping device for the contest. Eligible participants may enter the contest through the following methods:

Participants must follow the participation instructions. Once the entry rules are completed and participants follow 3 Amigos Restaurants on Instagram and/or Facebook, they will automatically receive one (1) entry. No purchase is required. List of restaurant locations is available at: https://3amigosrestaurants.com/en/restaurant/. Only one entry per customer is allowed.

All entries become the exclusive property of 3 Amigos Restaurants and will not be acknowledged or returned.

Participants are not allowed to share the same name, email address, or phone number. Any attempt by a participant to obtain more than the stated number of entries using multiple email addresses, identities, or other methods will void that participant’s entries and may result in disqualification. Use of automated systems, bots, or third parties to participate is prohibited and will result in disqualification.

GENERAL CONDITIONS:

If, for any reason, the operation or administration of this contest is impaired or unable to run as planned for any reason, including but not limited to (a) computer virus, bugs, (b) tampering, unauthorized intervention, (c) fraud, (d) technical failures, or (e) any cause beyond the control of 3 Amigos Restaurants that corrupts or affects the administration, security, fairness, integrity, or proper conduct of this contest, 3 Amigos Restaurants reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify, or suspend the contest in whole or in part at any time without notice, and to award the Grand Prize using all non-suspect, eligible entries received up to the date of cancellation or in any fair and appropriate manner consistent with the spirit of these Official Rules.

3 Amigos Restaurants also reserves the right to disqualify anyone found to be (a) tampering or attempting to tamper with the entry process or the operation of the contest or the website; or (b) acting in violation of these Official Rules or in a disruptive or unsportsmanlike manner.

WARNING: ANY ATTEMPT TO DELIBERATELY DAMAGE A WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL LAW. IF SUCH AN ATTEMPT IS MADE, 3 AMIGOS RESTAURANTS RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER LEGAL REMEDIES TO THE FULL EXTENT PERMITTED BY LAW.

Failure of 3 Amigos Restaurants to enforce any provision of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to the identity of a winner based on an email address, the winning entry will be declared by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” means the natural person to whom an email address is assigned by an Internet access provider or other organization responsible for assigning email addresses.

RELEASE AND LIMITATION OF LIABILITY:

By participating, entrants agree to release and hold harmless 3 Amigos Restaurants, the administrator, their employees, officers, directors, subsidiaries, affiliates, distributors, advertising and promotion agencies, and all other related parties (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation or receipt or use of any prize, including but not limited to: (a) technical errors; (b) unauthorized human intervention; (c) printing errors; (d) lost, delayed, misdirected, or undeliverable mail; (e) errors in the administration or processing of entries; or (f) injury or damage to persons or property arising directly or indirectly in connection with participation or prize use.

The Released Parties are not responsible for any technical malfunction of network, computer, or software equipment, or any email or entry not received due to technical issues or human error. The entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the contest and in no event shall the Released Parties be liable for attorney’s fees.

Participants waive all rights to punitive, incidental, consequential, or any other damages. The Released Parties are not liable in the event that the contest or any part of it is canceled due to weather, strike, war, pandemic, or any force majeure event.

DRAWING AND NOTIFICATION:

The potential Grand Prize winner (“Winner”) will be selected by random draw from all eligible entries by the administrator, whose decisions are final. The draw will take place on or around June 4, 2025, at 7:00 PM EST at the 3 Amigos Restaurant located at 1657 Saint-Catherine Street West, Montreal, Quebec H3H 1L. Odds of winning depend on the total number of eligible entries received during the Giveaway Period. The winner will be contacted via social media or email on June 5, 2025.

GRAND PRIZE AND PRIZE CONDITIONS:

One (1) Grand Prize will be awarded at the end of the Giveaway Period. The confirmed winner will receive a voucher for a trip to Mexico for themselves and/or guests, with a maximum value of $4,000 CAD. The winner must book travel through a designated travel agency or partner selected by 3 Amigos Restaurants. If the voucher is not used by May 6, 2026, it will be forfeited. All local laws and restrictions must be respected.

The winner will be contacted on June 5, 2025, and will have 24 hours from the time the notification email is sent to accept their prize. If the winner does not respond in time, another winner will be randomly drawn until a timely response is received.

By accepting the Grand Prize, the winner grants the Released Parties the right to use their name, likeness, voice, image, and/or biographical information for promotional purposes without further compensation, notification, or permission, where permitted by law.

IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE FOR ANY DAMAGES (INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING FROM PARTICIPATION OR PRIZE USE.

Participant information is subject to 3 Amigos Restaurants’ privacy policy, available at https://www.3amigosrestaurants.com. By entering, participants agree that their information may be shared with the contest administrator. To be removed from the mailing list, email 3amigosresto@gmail.com with your request.

DISPUTES:

By entering, participants agree that:

  1. Any disputes, claims, or causes of action will be resolved individually, without resort to class action;
  2. All claims will be limited to actual out-of-pocket costs associated with participation (no legal fees);
  3. Participants waive any right to claim punitive, incidental, consequential, or other damages beyond actual costs.

All issues regarding interpretation and enforceability of these rules shall be governed by Quebec law. If any provision is deemed unenforceable, it will not affect the remainder of the rules.
